Thomas H. Bienert, Jr. and the Bienert Katzman Littrell Williams LLP team scored a major victory by securing a not-guilty verdict on all charges against their client, Dr. Ramin Sarshad, after a seven-week trial in the United States District Court for the Central District of California.

The 75-count indictment alleged that Tom's client and three other doctors had billed Medicare for respiratory treatments that were never administered or were done so in violation of Medicare regulations.  The indictment charged Dr. Sarshad and his co-defendants with conspiracy to offer and receive illegal kickbacks in violation of the federal anti-kickback statute, and conspiracy to commit health care fraud, mail fraud, and wire fraud.   

After six days of deliberations, the 12-member jury unanimously acquitted Dr. Sarshad, rejecting the government's position that Sarshad knowingly and intentionally engaged in any illegal billing practices.  A copy of the jury's verdict is here.
