Representing a prominent oil & gas company and two of its principals, Bienert Katzman Littrell Williams LLP's Steven Jay Katzman and Anne Uyeda successfully obtained the discharge of an Order to Show Cause ("OSC") for the alleged violation of a Temporary Restraining Order ("TRO") relating to the acquisition of an oil facility. Steve and Anne also successfully opposed a related motion for terminating sanctions filed by the petitioning creditors in this bankruptcy matter.
In its 16-page Statement of Decision, the United States Bankruptcy Court for the Central District of California noted the complicated and "convoluted facts" relevant to the OSC and sanctions motion and the numerous discovery disputes that preceded nine days of testimony at hearings held "over nearly an 18-month period." After consideration of the testimony presented by the BKLW team and other parties, the "hundreds of exhibits" submitted by all parties, and multiple briefs, the Court found that there was no violation of the TRO and no basis for a civil contempt order, and discharged the OSC. The Court also determined that there was no basis shown for the imposition of discovery sanctions and denied the motion for terminating sanctions.
