The Daily Journal profile highlights Whitney’s recent case successes, including her complete victory for Mrs. Elizabeth Flynt, the widow of media mogul Larry Flynt, in a lawsuit filed against her by Mr. Flynt’s estranged brother, Jimmy Flynt. The federal court partially granted BKLW’s motion to dismiss, substantially narrowing Jimmy’s claims. Almost immediately, Jimmy entered into a walkaway settlement with Mrs. Flynt where he dismissed all of his claims with prejudice, gained nothing, and was precluded from appealing or bringing the meritless suit again, ending years of harassment towards Mrs. Flynt and the Hustler companies.
In her Daily Journal profile, Whitney attributes the win to her tenacity and Mrs. Flynt’s refusal to be bullied.
“We were relentless, and this was a stunning outcome,” she said of the victory. “My client wasn’t going to be shaken down. . . . I was so hungry to get that trial win, but in a way, this was even better.”
Whitney is currently lead counsel defending a prominent technology executive in a complex alleged $150 million wire fraud and money laundering case against Qualcomm in the Southern District of California. The government alleges that Whitney's client concealed his role in the development of technology Qualcomm purchased. The dispute was litigated and settled in civil court years ago without any liability, and the indictment does not make any new assertions. Substantive motions are scheduled to be heard in November.
